During this 3-hour program, seasoned panelists will focus on these topics:
- Domestic Violence and the Military - The Camouflage Connection: When faced with a domestic violence case, counsel for the victim (and for the accused) must have a thorough understanding of the rights and remedies-from rehabilitation to punishment-which are available if either of the parties is in the military. This program covers the available civil remedies and criminal processes, as well as the impact on military service. This includes the military protective order (used by the commander of the perpetrator), preferring court-martial charges against a military member, the Family Advocacy Program, confidentiality for the reporting individual, and restrictions on using personal and government weapons under the Lautenberg Amendment. Finally, this examines Transitional Compensation for the victim and how to divide a non-existent military pension. (1 hour, including 10 minutes for questions)
- 10-minute break
- Military Pension Division: Dividing a military pension can be a daunting task. What is divisible - gross pension, or only "disposable retired pay"? How do you calculate disposable retired pay? When a servicemember is sued for pension division in another state, how can that court acquire jurisdiction over the servicemember? How does one get a garnishment for the pension? All these and more are covered in this presentation. (1 hour, including 10 minutes for questions)
- 10-minute break
- Servicemembers Civil Relief Act and Family Law: When you mix military personnel, child support payments, Reserve/Guard mobilizations, custody and visitation, and large-scale deployments of servicemembers, unpredictable results occur. Today's legal terrain is littered with developing case law involving substitute visitation for family members, 90-day stays requests for custody hearings, interim child support issues and family care plans for service personnel. This presentation gives the audience a current snapshot of cutting-edge issues for the family law practitioner on the evolving interface between domestic relations and the SCRA. (1 hour, including 10 minutes for questions)
